Open peer commentary on the article “Constructing Constructivism” by Hugh Gash. Upshot: The concept of “constructivist teaching” seems unattainable for two reasons: a philosophical and an empirical one. Also, Hugh Gash’s survey is not so much about radical constructivism in education, but a review of different connected ideas labeled “constructivism” that have dominated the educational field.

This collection of essays contains revised versions of papers delivered at a conference entitled “Duty, Interest, and Practical Reason: Aristotle, Kant, and the Stoics” that was organized by Stephen Engstrom and Jennifer Whiting at the University of Pittsburgh in 1994. One of the main aims of the conference was to bring together scholars on Aristotle, the Stoics, and Kant to reevaluate the common view that Greek and Kantian ethics represent fundamentally opposed conceptions of ethical theory and the roles of (...) morality and happiness in practical reasoning. According to a common view, the ancients are eudaimonists; they derive or justify the virtues by showing how they contribute to the agent’s own eudaimonia or happiness. By contrast, Kant sharply criticizes eudaimonism for deriving or justifying morality in terms of happiness. This criticism applies to eudaimonism of all sorts, even Stoic eudaimonism, which is perhaps closer in some respects to Kant’s own views, and of which he is somewhat less critical than he is of other forms of eudaimonism. For Kant, moral duty and respect for the moral law must be grounded in reason itself and cannot be made to depend on any independent standard. These and related assumptions about ancient and Kantian ethics have helped structure much contemporary systematic work in ethical theory, as well as common conceptions of these ethical traditions. But this common view has been under reexamination lately; some of the most interesting work in the history of ethics in recent years has been in Greek and Kantian ethics, and much of it challenges one or another aspect of the received view of the ethical theory and moral psychology of Kant or the Greeks. However, with some exceptions, renewed interest and recent work in these two traditions has proceeded in parallel. The conference aimed to correct this, by bringing together some of the most distinguished scholars of ancient and modern ethics to compare and assess the role of moral duty and happiness in the two traditions. Most of the essays have such a comparative assessment as their main theme; but even those that focus more exclusively on one of the traditions contribute indirectly to this comparative assessment. The dual character of invariance under transformations and definability by some operations has been used in classical works by, for example, Galois and Klein. Following Tarski, philosophers of logic have claimed that logical notions themselves could be characterized in terms of invariance. In this article, we generalize a correspondence due to Krasner between invariance under groups of permutations and definability in L∞∞ so as to cover the cases that are of interest in the logicality debates, getting McGee’s theorem about quantifiers (...) invariant under all permutations and definability in pure L∞∞ as a particular case. We also prove some optimality results along the way, regarding the kinds of relations which are needed so that every subgroup of the full permutation group is characterizable as a group of automorphisms. Kant holds that the human cognitive power is divided into two "stems", understanding and sensibility. This doctrine has seemed objectionably dualistic to many critics, who see these stems as distinct parts, each able on its own to produce representations, which must somehow interact, determining or constraining one another, in order to secure the fit, requisite for cognition, between concept and intuition. This reading cannot be squared, however, with what Kant actually says about theoretical cognition and the way understanding and sensibility (...) cooperate in it. Such cognition, as Kant conceives of it, satisfies two conditions: it has unity, and it depends on the existence of its object. The first of these conditions entails that the cognitive power must lie in spontaneity, or understanding, while the second implies that this spontaneity depends on receptivity, or sensibility, to be the cognitive power that it is. Consideration of how these capacities must be conceived as cooperating in cognition reveals them to be related, not as interacting parts, but as form and matter. Such a conception of their relation may at first glance seem to be merely another version of dualistic thinking; in fact, however, a proper appreciation of it eliminates the appearance of dualism and helps allay an associated concern that Kant's distinction would taint our cognition with an unacceptable subjectivism. BackgroundPsychiatric staff members have the power to decide the options that frame encounters with patients. Intentional as well as unintentional framing can have a crucial impact on patients’ opportunities to be heard and participate in the process. We identified three dominant ethical perspectives in the normative medical ethics literature concerning how doctors and other staff members should frame interactions in relation to patients; paternalism, autonomy and reciprocity. The aim of this study was to describe and analyse statements describing real work (...) situations and ethical reflections made by staff members in relation to three central perspectives in medical ethics; paternalism, autonomy and reciprocity.MethodsAll staff members involved with patients in seven adult psychiatric and six child and adolescent psychiatric clinics were given the opportunity to freely describe ethical considerations in their work by keeping an ethical diary over the course of one week and 173 persons handed in their diaries. Qualitative theory-guided content analysis was used to provide a description of staff encounters with patients and in what way these encounters were consistent with, or contrary to, the three perspectives.ResultsThe majority of the statements could be attributed to the perspective of paternalism and several to autonomy. Only a few statements could be attributed to reciprocity, most of which concerned staff members acting contrary to the perspective. The result is presented as three perspectives containing eight values.•Paternalism; 1) promoting and restoring the health of the patient, 2) providing good care and 3) assuming responsibility.•Autonomy; 1) respecting the patient’s right to self-determination and information, 2) respecting the patient’s integrity and 3) protecting human rights.•Reciprocity; 1) involving patients in the planning and implementation of their care and 2) building trust between staff and patients.ConclusionsPaternalism clearly appeared to be the dominant perspective among the participants, but there was also awareness of patients’ right to autonomy. Despite a normative trend towards reciprocity in psychiatry throughout the Western world, identifying it proved difficult in this study. This should be borne in mind by clinics when considering the need for ethical education, training and supervision. (shrink)

This paper considers a principal concept of metaphysics – the category of substance – as it figures in Kant’s critical program of establishing metaphysics as a science. Like Leibniz, Kant identifies metaphysical concepts through logical reflection on the form of cognitive activity. He thus begins with general logic’s account of categorical judgment as an act of subordinating predicate to subject. This categorical form is then considered in transcendental logic with reference to the possibility of its real use. Transcendental reflection reveals (...) that the categorical form, in its potential for such use, constitutes the category of substance and accident, representing a first real subject and a determination of its existence. But to qualify for objective, scientific employment, metaphysics’ concepts must admit of real definitions, which show their objects to be possible, and such possibility, pace Leibniz, can be established only in relation to possible experience. Thus, relying on his doctrine of the schematism, Kant shows the category to figure constitutively in experience, as the ground of the first law of nature, that in all change substance persists. This paper examines a specific appeal to philosophical anthropology—Andy Clark's—and the role it plays in shaping his account of our fundamental cyborg humanity." By focusing on the theme of embodiment, we also inquire into how phenomenology might benefit from Clark's account as well as how Clark's account might benefit from further engagement with phenomenology. Throughout, we explore inter- and intra-disciplinary questions that highlight the contribution the philosophy of technology can make to our understanding of embodiment and philosophical anthropology.

We expand the notion of resplendency to theories of the kind T + p", where T is a fi rst-order theory and p" expresses that the type p is omitted. We investigate two di erent formulations and prove necessary and sucient conditions for countable recursively saturated models of PA. AimsTo examine attitudes towards physician-assisted suicide (PAS) among physicians in Sweden and compare these with the results from a similar cross-sectional study performed in 2007.ParticipantsA random selection of 250 physicians from each of six specialties (general practice, geriatrics, internal medicine, oncology, surgery and psychiatry) and all 127 palliative care physicians in Sweden were invited to participate in this study.SettingA postal questionnaire commissioned by the Swedish Medical Society in collaboration with Karolinska Institute in Stockholm. ResultsThe total response rate was 59.2%. Slightly (...) fewer than half [47.1% (95% CI 43.7–50.5)] of the respondents from the six specialties accepted PAS, which is significantly more than accepted PAS in the 2007 study [34.9% (95% CI 31.5–38.3)]. Thirty-three percent of respondents were prepared to prescribe the needed drugs. When asked what would happen to the respondent’s own trust in healthcare, a majority [67.1% (95% CI 63.9–70.3)] stated that legalizing PAS would either not influence their own trust in healthcare, or that their trust would increase. This number is an increase compared to the 2007 survey, when just over half [51.9% (95% CI 48.0–55.2)] indicated that their own trust would either not be influenced, or would increase.ConclusionsThe study reveals a shift towards a more accepting attitude concerning PAS among physicians in Sweden. Only a minority of the respondents stated that they were against PAS, and a considerable proportion reported being prepared to prescribe the needed drugs for patient self-administration if PAS were legalized. In his very rich and insightful book, Kant's Theory of Freedom, Henry Allison argues that in the first Critique Kant's reason for rejecting Humean compatibilism in favor of an incompatibilist conception of practical freedom stems, not from a specific concern to ground morality, as many have supposed, but from his general conception of rational agency, which Allison explicates in terms of the idea of practical spontaneity. Practically spontaneous rational agency is subject to imperatives and therefore distinct from Humean agency. But (...) it is not necessarily subject to the categorical imperative and hence is distinct from fully spontaneous (transcendentally free) moral agency. A conception thus emerges of an agent with limited spontaneity, subject to hypothetical but not categorical imperatives. A doubt may be raised, however, as to whether Kant's view can accommodate this conception of limited practical spontaneity. Reflection on Kant's notion of a hypothetical imperative suggests that the idea of limited spontaneity is in danger of either collapsing into the Humean picture or else turning out to be equivalent to the conception of full spontaneity appropriate to moral agency. There is thus reason to suppose that, for Kant, we would not be bound by imperatives at all if we were not bound by the categorical imperative. (shrink)

By examining the contingent alliance that has emerged between the computational theory of mind and cyborg theory, we discern some questionable ways in which the literalization of technological metaphors and the over-extension of the “computational” have functioned, not only to influence conceptions of cognition, but also by becoming normative perspectives on how minds and bodies should be transformed, such that they can capitalize on technology’s capacity to enhance cognition and thus amend our sense of what it is to be “human”. Comparative philosophy is dependent upon translation, often translations that will help preserve some fundamental commitments: to linguistic mastery, to the recovery or preservation of an original, and to the protection of an authenticity that will ground these commitments. Such a view can sometimes obscure a nostalgia for questionable causes. Comparative philosophy, especially with continental affinities, often relies on two moves: first, a boundary must be found (or produced) between philosophy itself and other forms of writing (literature or fiction, say), to (...) ensure proper grounding. Second, it must be understood that this boundary depends upon an underlying philosophy of language: language speaks us, it speaks Being; to dwell in a different language is to dwell in a different house of being (Martin Heidegger). But how might this project – its historiography of return and grounding, and its mythologizing of linguistic and ontological recovery – be challenged by the very practice of translation itself? Perhaps this challenge is one of translation’s philosophical benefits. (shrink)

In her recent book, Barbara Herman explores a range of topics commonly associated with virtue ethics; her focus, however, is not so much on virtue as on normal moral competence and the basic moral capacity underpinning it. To explicate this competence, Herman introduces the idea of moral literacy, arguing that it reveals Kantian ethical thought to be better able than Humean views to account for our readiness to hold persons responsible even for conduct reflecting character flaws that stem from deficiencies (...) in their upbringing. Examination of Herman's account raises a question, however, about how intimately moral literacy is related to the basic moral capacity. (shrink)

BackgroundWe aim to further develop an index for detecting disguised paternalism, which might influence physicians’ evaluations of whether or not a patient is decision-competent at the end of life. Disguised paternalism can be actualized when physicians transform hard paternalism into soft paternalism by questioning the patient’s decision-making competence. MethodsA previously presented index, based on a cross-sectional study, was further developed to make it possible to distinguish between high and low degrees of disguised paternalism using the average index of the whole (...) sample. We recalculated the results from a 2007 study for comparison to a new study conducted in 2020. Both studies are about physicians’ attitudes towards, and arguments for or against, physician-assisted suicide. ResultsThe 2020 study showed that geriatricians, palliativists, and middle-aged physicians (46–60 years old) had indices indicating disguised paternalism, in contrast with the results from the 2007 study, which showed that all specialties (apart from GPs and surgeons) had indices indicating high degrees of disguised paternalism.ConclusionsThe proposed index for identifying disguised paternalism reflects the attitude of a group towards physician assisted suicide. The indices make it possible to compare the various medical specialties and age groups from the 2007 study with the 2020 study. Because disguised paternalism might have clinical consequences for the rights of competent patients to participate in decision-making, it is important to reveal disguised hard paternalism, which could masquerade as soft paternalism and thereby manifest in practice. Methods for improving measures of disguised paternalism are worthy of further development. (shrink)

In this response essay, we argue that Andy Clark’s assessment of our position on cyborgs is rooted in a misconception of the notion of “interaction” that we advance.

As social media becomes increasingly popular, human subjects researchers are able to use these platforms to locate, track, and communicate with study participants, thereby increasing participant retention and the generalizability and validity of research. The use of social media; however, raises novel ethical and regulatory issues that have received limited attention in the literature and federal regulations. We review research ethics and regulations and outline the implications for maintaining participant privacy, respecting participant autonomy, and promoting researcher transparency when using social (...) media to locate and track participants. We offer a rubric that can be used in future studies to determine ethical and regulation-consistent use of social media platforms and illustrate the rubric using our study team’s experience with Facebook. Stephen Engstrom has recently offered an excellent account of morality as practical cognition. He emphasizes the formal conditions of practical knowledge, which he finds in Kant. Engstrom also aligns his account with constructivism, claiming that value is constructed through these formal conditions, chiefly universalisability. In this paper, I employ a variant of Hegel’s empty-formalism objection to challenge the moral significance of the mere form of practical knowledge. I hope to show that Engstrom’s constructivism is neither philosophically compelling, (...) nor required by the rest of his position. In its place, I propose a realist understanding of the value of practical knowledge. (shrink)

Selinger and Engstrom, A moratorium on cyborgs: Computation, cognition and commerce, 2008 (this issue) urge upon us a moratorium on ‘cyborg discourse’. But the argument underestimates the richness and complexity of our ongoing communal explorations. It leans on a somewhat outdated version of the machine metaphor (exemplified perhaps by a frozen 1970’s Cyborg). The modern cyborg, informed by an evolving computational model of mind, can play a positive role in the critical discussions that Selinger and Engstrom seek.

The Indonesian Ulema Council (MUI) has issued an illegitimate fatwa against smoking in mosques because it endangers the health of worshippers and interferes with the comfort of worshippers. This study aims to investigate smoking behaviour in mosques and violations of fatwas from ulama and governor regulations. This study follows a cross-sectional design conducted by interviewing 531 Muslims who have prayed in the mosque for the last 14 days and observed the compliance of the mosque in implementing a smoke-free policy in (...) 315 mosques. Frequency distribution and cross-tabulation were carried out using JASP 16 software using cross-tabulation. The results of this study indicate that the implementation of the smoke-free policy for mosques in Medan has been violated many times (57.8%), especially the violation regarding smoking in mosques (32.1%); cigarette butts were still found in the yard of the mosque (44.1%). Violations of the policy of fatwa smoke-free areas occurred in public mosques (61%) and muhammadiyah mosques (46.5%). Smoking behaviour in mosques was seen in the last 2 weeks, namely smoking behaviour carried out by worshippers (57.6%), smoking behaviour carried out by mosque administrators (39.2%), smoking behaviour carried out by community leaders in mosques (19.4%) and smoking behaviour that ulemas carried out in mosques (14.3%). Worshippers must comply with the rules against smoking in mosques because it can endanger the health of other worshippers. Cigarette smoke in the mosque will make other worshippers uncomfortable to worship so that it can damage the solemnity of the congregation to worship in the mosque. Contribution: This study is expected to explain smoking behaviour in mosques, violations of smoking behaviour in mosques that violate the ulama’s fatwa regarding smoking behaviour in mosques and the governor’s regulation on smoking behaviour in mosques. Introduction Hundreds of thousands of premature neonates born in low-income countries are implicitly denied treatment each year. Studies from India show that treatment is rationed even for neonates born at 32 gestational age weeks (GAW), and multiple external factors influence treatment decisions. Is withholding of life-saving treatment for children born between 28 and 32 GAW acceptable from an ethical perspective? Method A seven-step impartial ethical analysis, including outcome analysis of four accepted priority criteria: severity of disease, treatment effect, cost effectiveness (...) and evidence for neonates born at 28 and 32 GAW. Results The ethical analysis sketches out two possibilities: (a) It is not ethically permissible to limit treatment to neonates below 32 GAW when assigning high weight to health maximisation and overall health equality. Neonates below 32 GAW score high on severity of disease and efficiency and cost-effectiveness of treatment if one gives full weight to early years of a newborn life. It is in the child's best interest to be treated. (b) It can be considered ethically permissible if high weight is assigned to reducing inequality of welfare and maximising overall welfare and/or not granting full weight to early years of newborns is considered acceptable. From an equity-motivated health and welfare perspective, we would not accept (b), as it relies on accepting the lack of proper welfare policies for the poor and disabled in India. Conclusion Explicit priority processes in India for financing neonatal care are needed. If premature neonates are perceived as worth less than other patient groups, the reasons should be explored among a broad range of stakeholders. (shrink)

A new book by Stephen Engstrom repeats a criticism of Bruce Aune's of Kant's derivation of the universalizability formula of the categorical imperative. The criticism is that Kant omitted at least one substantive premise in the derivation of the formula: ‘Act only on that maxim through which you can at the same time will that it become a universal law.’ The grounds for the formula that are given in the Groundwork of the Metaphysics of Morals, however, are said to (...) support only a weaker requirement, namely, that a maxim conform to a universal law. Hence, Kant omits at least one necessary substantive premise of the derivation. This paper attempts to show that nothing substantive is omitted from the argument. It only needs two principles of inference that it is assumed add nothing substantive to the premises. (shrink)

Polyclonal antibodies raised against the human erythrocyte nucleoside transporter were used to investigate the distribution of the nucleoside transporters in the placenta. Immunoblots of brush-border membranes isolated from the human syncytiotrophoblast revealed a cross-reactive species that co-migrated with the erythrocyte nucleoside transporter as a broad band of apparent M 55,000. In contrast, no labelling was detected in basal membranes containing a similar number of equilibrative nucleoside transporters as assessed by nitrobenzylthioinosine -binding. The absence of cross-reactive epitopes in basal membranes and (...) their presence in brush-border membranes was confirmed by confocal immunofluorescence microscopy. The results suggest that at least two isoforms of the NBMPR-sensitive nucleoside transporter are present in the human placenta. The lumenal surfaces of fetal capillaries, small placental vessels and umbilical vein ware also strongly labelled by the antibody, a finding that suggests that the high fetal-placental adenosine uptake previously reported is due to endothelial transporters.
